I have a feeling I'm working with the most argumentative person possible tomorrow, so just wanted to check my assumptions....How do I know I'm entitled to lactation breaks? I've taken them every other time, and not "made up" the time, although usually I've taken them as part of a meal break, IYKWIM, since what has to get done has to get done....I haven't actually discussed it with my boss this time round, just going on what happened last time (same boss etc), but knowing my luck I'll be working with Ms Argumentative and boss will be MIA if I need back-up...

It's in my workplace agreement. Not sure if there something more general that applies to everyone though?

I'm pretty sure there's no entitlement to them, but you may have something in you workplace agreement/contract, or it might be part of the arrangement you made with your employer when you returned to work (hopefully that's in writing)

Otherwise, check with the bfwa website (you can find it from the main ABA site) for legal rights and other suggestions for negotiations

you can also argue it's an oh and s issue - if you dont pump they you'll prob get mastitis.

its also a discrimination thing - if you dont have the breaks then you can't work which is sexual discrimination (1984 federal law)

Hmmm...I couldn't find anything specific in the workplace agreement....plenty of talk about flexible options to enable return to work, though, that should theoretically cover it.

Ms Argumentative is the OHS rep, so things will get interesting if I have to take that line :lol:

I'm also yet to hunt out a place to pump, so I hope it's really really quiet tomorrow - I'm supposed to have just a half hour break!

Wish me luck! I'm more nervous now than last week, when I was supposed to go back, but my kids caught gastro!

Good luck for tomorrow - hope that it works out for you. The OH&S issue is definitely one to argue. The bfwa has some other good arguments too.

Ms argumentative needs to check her facts. Definitely oh&s issue and also in anti-discrimination legislation now. As of last year, it's legal for a mother to express or breastfeed where ever and whenever we need.

She may be on a steep learning curve tomorrow - have fun :-D
